Terms of Service
Effective date: October 20, 2026
These terms are an agreement between you and Slatter Consulting, Inc., doing business as Better Practice ("Better Practice," "we," "us"). They cover your use of Better Together at my.betterpractice.com and our website at betterpractice.com (together, the "Service").
1. Agreeing to these terms
By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, don't use the Service.
Most people use Better Together through an organization, such as their employer. The organization that holds the account is the "Customer." If you sign up on behalf of an organization, you confirm that you have authority to accept these terms for it, and "you" includes that organization.
If your organization has signed a separate written agreement with us for something, such as a coaching engagement, that agreement governs what it covers. These terms govern everything else.
2. Accounts
- Eligibility. You must be at least 18 to use the Service. We operate from the United States. If you use the Service from another country, you’re responsible for complying with local laws, including getting any consent needed to transfer personal data to the US.
- Accurate information. Give us accurate account information and keep it current.
- Your password. Keep your login details private. You're responsible for activity under your account. Tell us right away at help@betterpractice.com if you think someone else has accessed it.
- Organization control. If you joined through an organization, its administrators control your access. They can invite you, assign your roles and teams, and remove your seat. Questions about your access go to your organization first.
- One person per account. Don't share accounts or create accounts for other people without their knowledge.
3. Plans and billing
Better Together has a free plan and paid plans. The features, seats, and price of your plan are what you agreed to when you subscribed.
- Automatic renewal. Paid plans renew automatically at the end of each billing period until cancelled. We charge the payment method on file through our payment processor, Stripe.
- Cancelling. You can cancel anytime. Your paid plan continues until the end of the period you've paid for, then your organization moves to the free plan. Your data stays, so you can pick up where you left off if you subscribe again.
- No refunds. Fees already paid are not refunded, including for unused time, unused seats, or partial periods.
- Seat changes. Adding seats increases your charges, which may be prorated for the current period.
- Price changes. We'll give you at least 30 days' notice before a price change takes effect. The new price applies from your next billing period after that notice.
- Failed payments. If a payment fails and isn't resolved, we may move your organization to the free plan.
- Taxes. Prices don't include taxes. You're responsible for any sales or similar taxes on your subscription.
4. Your content and data
You own your content. Responses, comments, goals, feedback, and anything else you or your organization put into Better Together ("Your Content") belong to you or your organization.
What you allow us to do with it. You give us permission to host, store, process, and display Your Content to provide, secure, and support the Service, including through the service providers listed in our Privacy Policy. We use it only as described in these terms and the Privacy Policy.
Aggregated data. We may combine de-identified data from across our customers to create benchmarks, norms, and statistics, and to improve the Service. This aggregated data does not identify you or your organization, and we own it. It stays in our norms even after your account is deleted.
Your responsibility for Your Content. You confirm you have the right to submit Your Content, and that it doesn't violate these terms or anyone's rights.
Suggestions. If you send us ideas or feedback about the Service, we may use them without any obligation to you.
5. Responsible use
Not for employment decisions. Better Together is built to help teams reflect and improve. Pulse results, benchmark results, coworker feedback, and AI summaries are not designed or validated for hiring, firing, promotion, compensation, discipline, or other employment decisions. Customers agree not to use them as a basis for those decisions. If a Customer does, it is solely responsible for that use.
Don't use the Service to:
- Harass, threaten, or demean anyone, including in written comments and coworker feedback.
- Try to identify who wrote a response that the Service shows without a name.
- Submit anything illegal, or anything that violates someone's privacy or intellectual property.
- Submit sensitive information the Service doesn't ask for, such as health, financial, or government ID details.
- Access accounts, teams, or data you aren't authorized to see.
- Probe, scan, or disrupt the Service, or get around its security or usage limits.
- Scrape, copy, or resell the Service or its content, or use it to build a competing product.
We may remove content or restrict accounts that break these rules (see Section 9).
6. AI features
Some features, including our assistant Jax and coworker feedback summaries, use AI to generate content.
- AI can be wrong. AI output can be inaccurate, incomplete, or misleading. Review it before relying on it.
- Not professional advice. AI output is not legal, HR, medical, or psychological advice.
- Organization settings. Customers can hide AI features for their organization.
- No model training. We don't use Your Content to train AI models. How AI providers handle data is described in our Privacy Policy.
7. Coaches
Teams can include people in a coaching role. Coaches may be Better Practice staff, outside consultants, or the Customer's own people.
- Customers choose their coaches. When a Customer gives coach access to an outside consultant or one of its own people, the Customer is responsible for that choice and for that person's use of the Service.
- Our staff. Better Practice is responsible for its own staff who act as coaches.
- Coaching engagements. Coaching sold under a separate agreement is governed by that agreement.
- No guaranteed results. Coaching and the Service support team improvement, but we don't guarantee any particular outcome.
8. The Service itself
Our content. The Service, including its software, design, surveys, benchmarks, courses, quizzes, videos, and other learning content, belongs to Better Practice and its licensors. While you have an account, we give you a limited, non-transferable right to use it for your organization's internal purposes. Don't copy, modify, distribute, or reverse engineer it, except as the law allows.
Third-party services. Some features connect to other services, such as Slack, or include content from them, such as Vimeo videos. Your use of those services is governed by their own terms. We aren't responsible for them.
Changes and availability. We're always improving Better Together, so we may add, change, or remove features, including what's included in the free plan. We'll give reasonable notice before removing a feature that paid plans depend on. We don't promise any particular uptime or support response time, and the Service may sometimes be unavailable for maintenance or for reasons outside our control.
9. Suspension and termination
You can leave anytime. Cancel your paid plan as described in Section 3, or ask us to delete your account at help@betterpractice.com. Deletion is handled as described in our Privacy Policy.
We may suspend or close accounts if you seriously or repeatedly break these terms, if your use creates a security or legal risk, or if the law requires it. When reasonable, we'll warn you first and give you a chance to fix the problem. We may also remove individual content that breaks Section 5 without closing an account.
What survives. If these terms end, the sections that should logically continue still apply, including Sections 4 (aggregated data), 10, 11, 12, and 13.
10. Disclaimers
THE SERVICE, INCLUDING AI OUTPUT, BENCHMARKS, AND LEARNING CONTENT, IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, BETTER PRACTICE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DON'T PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT IT WILL PRODUCE ANY PARTICULAR RESULT FOR YOUR TEAM.
11. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS:
- BETTER PRACTICE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
- BETTER PRACTICE'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT THE CUSTOMER PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.
These limits apply whatever the legal theory, and even if a remedy fails of its essential purpose.
12. Indemnification
The Customer will defend and indemnify Better Practice, and its officers, employees, and contractors, against third-party claims and related costs, including reasonable attorneys' fees, arising from:
- Your Content.
- The Customer's or its users' violation of these terms or the law.
- Any use of the Service as a basis for employment decisions.
- The acts of coaches the Customer chose, other than Better Practice staff.
13. Disputes
Colorado law governs these terms, without regard to conflict-of-law rules. Any dispute will be resolved only in the state courts located in Arapahoe County, Colorado, or the United States District Court for the District of Colorado, and both sides consent to those courts' jurisdiction. Before filing a claim, please email help@betterpractice.com so we can try to resolve it informally.
14. Changes to these terms
We may update these terms. For material changes, we'll notify you by email or in the app at least 30 days before they take effect. If you keep using the Service after that, you accept the updated terms. If you don't agree, cancel before they take effect.
15. General
- Entire agreement. These terms and our Privacy Policy are the whole agreement between you and us about the Service, except where a separate signed agreement applies (Section 1).
- Assignment. You can't transfer these terms without our written consent. We may transfer them as part of a merger, acquisition, or sale of assets.
- Severability. If a court finds part of these terms unenforceable, the rest stays in effect.
- No waiver. If we don't enforce a provision right away, we haven't given up the right to enforce it later.
- Events beyond our control. We aren't responsible for delays or failures caused by events outside our reasonable control, such as outages at our providers, natural disasters, or acts of government.
- Notices. We'll send notices to the email address on your account. Send notices to us at the contact details below.
